There were various reasons given for preventing the will going to probate, including that it attempted to manumit slaves contrary to law. Two witnesses deposed that Sanders had neither signed nor read the will in their presence; one stated that he believed it to have been in the handwriting of Jeffrey Hutchens, one of the witnesses and the executor. The will gave all the testator's property to Hutchens and one John Power and directed Hutchens, as executor, to purchase and then free a slave called Rose. The court found in favour of Fleming, the propounder, and Webb excepted. The Supreme Court confirmed the lower court's verdict but declared void the passages in the will relating to Rose's manumission.
